APM 025
Conflict of Commitment and
Outside Activities of Faculty Members
IMPLEMENTATION OF APM 025: Questions and Answers
Addendum, June 2002
26. Is teaching at another UC campus while on sabbatical leave a Category
I activity?
Yes. The provisions of APM 025 apply to faculty while on sabbatical leave. Therefore, teaching at a UC campus is a Category I activity, (as is teaching at any non-UC institution). It requires prior written approval of the Campus Provost/Executive Vice Chancellor. [See questions #19, 20 and 21 for additional information regarding outside activities for faculty on other types of leave.]
27. Can a Category I activity be denied if a faculty member has not exceeded the 39/48 day limit? In other words, is approval discretionary or is the 39/48 day allowance an entitlement? For example, if a faculty member's performance in the service area is deficient, can a Category I activity be denied on that basis even if the day limit has not been exceeded?
The policy language in APM 025-10[c](1) states that Category I activities may be engaged in only with the Campus Provost/Executive Vice Chancellor approval. There is no entitlement to engage in these activities.
28. If an academic-year faculty member goes on leave without pay for one quarter, is the 39-day limit pro-rated for the remaining two quarters?
Yes, a faculty member active for two quarters of the academic year would have a 26-day limit on compensated outside professional activities.
29. Is prior approval required when a faculty member is consulting for an outside company but is placed on that company's payroll instead of a vendor contract? This is sometimes done for the outside employer's convenience - but the actual relationship is one of consultant not employee.
The policy language in APM 025-10{c}(1) states that establishing a relationship as a salaried employee outside the University is a Category I activity. Prior approval is required in this case.
30. Is prior approval required when the student engaged in outside professional activity with a UCSC faculty member is not a UCSC student?
Prior approval is not required when the student is not a UCSC student.
31. Is prior approval required when a student involves a faculty member in an outside professional activity?
Yes. The requirements for prior approval apply, whether the activity is paid or unpaid (see APM 025-60).
32. The Prior Approval Form includes, "equity/royalty interest" in #3 (nature of the relationship between individual and business entity). Does this apply to royalty/equity interests in publications, performances, etc. which are Category III activities?
If the royalty/equity interest relates to a Category I activity, then it should be reported. For example, if the faculty member were a salaried employee outside the University and his or her relationship with that company or organization involved an equity interest or compensation in the form of royalties, then that would have to be reported. If a faculty member received royalties from a Category III activity, such as a book or film, then it would not need to be reported.
33. What is the retention period for the reporting forms?
These reports should be retained for three years after the period reported on.

34. If I am on a sabbatical leave that is only partially funded (e.g., a 2/3 sabbatical leave), must I report on the non UC-paid portion of that leave?
Yes, the entire leave period must be reported on, even though it is a leave
with partial pay. For purposes of APM 025, a sabbatical leave on partial pay
is considered a full-time University appointment. (See APM
740-19)
